BleachMe GmbH, Bahnhofstrasse 8b, 6340 Baar (hereinafter referred to as "Provider" or "we") is the operator of the "LipBoom" products and the provider of the "LipBoom" service. We take the protection of your personal data very seriously and observe the requirements of the European Data Protection Regulation (DSGVO), the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG) when collecting, processing and using your data. The following statement gives you an overview of how we ensure data protection and what type of data is collected for what purpose.

  1. Collection, processing and use of personal data

"Personal data" are all individual details about your personal or factual circumstances. This includes all information that allows a conclusion to your identity (e.g. name, address, e-mail address, bank details, etc.).

The collection, storage and processing of personal data is governed exclusively by applicable law. We undertake to handle the data provided by you responsibly and with the utmost care.

The website www.lipboom.ch and our systems are protected by technical and organizational measures against loss, destruction, access, modification or distribution of your data by unauthorized persons. Despite regular checks, however, complete protection against all dangers is not possible.

The use of the invoice payment method requires a positive credit check. In this respect, we forward your data to Klarna for the purpose of address and credit checks as part of the purchase initiation and processing of the purchase contract.   1. Purposes of the processing of your personal information

We process personal information to operate, provide and improve the services we offer to our customers. We use the data we receive from you to:

  • to send appointment confirmations
  • to offer logistics services including shipment tracking,
  • to improve the website and our services,
  • To answer your questions and provide appropriate customer service,
  • To send you offers or newsletters if necessary,

  • to allow us to seek possible legal remedies and to limit any damages we may incur.
  1. Data collection when visiting our website

In the case of purely informational use of our website, i.e. if the user does not register or otherwise transmit information to us, we only collect data that the browser transmits to our server (so-called "server log files"). When you visit our website, we collect the following data, which is technically necessary for us to display the website to you:    

  • Our visited website
  • Date and time at the time of access
  • Amount of data sent in bytes
  • Source/reference from which you reached the page
  • Browser used
  • Operating system used
  • IP address used (if applicable: in anonymised form)

The processing is based on our legitimate interest in improving the stability and functionality of our website. The data is not passed on or used in any other way. However, we reserve the right to check the server log files retrospectively if there are concrete indications of illegal use.   

 

 

  1. Data processing for contract management

In order to process your order, we work together with service providers who support us in whole or in part in the execution of concluded contracts (for example, payment service providers such as Klarna, Twint, etc.). Certain personal data is transmitted to these service providers in accordance with the following information. The personal data collected by us will be passed on to the transport company commissioned with the delivery as part of the contract processing, insofar as this is necessary for the delivery of the goods. We pass on your payment data to the commissioned credit institution within the scope of payment processing, insofar as this is necessary for payment processing. 

  1. Third-party analytics and tools

When visiting our website, your surfing behaviour can be statistically evaluated. This is done primarily with cookies and with so-called analysis programs. The analysis of your surfing behaviour is usually anonymous; the surfing behaviour cannot be traced back to you. You can object to this analysis or prevent it by not using certain tools. The internet pages partly use so-called cookies. Cookies do not cause any damage to your computer and do not contain viruses. Cookies serve to make our offer more user-friendly, effective and secure. Cookies are small text files that are stored on your computer and saved by your browser.

  • Any person concerned by the processing of personal data has the right, granted by the European Directive and Regulation, to obtain at any time from the controller, free of charge, information about the personal data stored about him or her and a copy of that information. Furthermore, the European Directive and Regulation has granted the data subject access to the following information:
  • the processing purposes
  • the categories of personal data processed
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular in the case of recipients in third countries or international organisations
  • if possible, the planned duration for which the personal data will be stored or, if this is not possible, the criteria for determining this duration
  • the existence of the right to obtain the rectification or erasure of personal data concerning him or her, or the restriction of processing by the controller, or the right to object to such processing
  • the existence of a right of appeal to a supervisory authority
  • if the personal data are not collected from the data subject: All available information on the origin of the data
  • the existence of automated decision-making, including profiling, pursuant to Article 22(1) and (4) of the GDPR and, at least in these cases, meaningful information about the logic involved and the scope and intended effects of such processing for the data subject
  • The data subject shall also have the right to obtain information as to whether personal data have been transferred to a third country or to an international organisation. If this is the case, the data subject shall also have the right to obtain information on the appropriate safeguards in relation to the transfer.

  • Any person concerned by the processing of personal data has the right, granted by the European Directive and the Regulation, to obtain from the controller the erasure without delay of personal data concerning him or her, where one of the following reasons applies and insofar as the processing is not necessary:
  • The personal data were collected or otherwise processed for purposes for which they are no longer necessary.
  • The data subject revokes the consent on which the processing was based pursuant to Article 6(1)(a) of the GDPR or Article 9(2)(a) of the GDPR and there is no other legal basis for the processing.
  • The data subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.
  • The personal data have been processed unlawfully.
  • The deletion of the personal data is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject.
  • The personal data was collected in relation to information society services offered pursuant to Article 8(1) DS-GVO.

If one of the aforementioned reasons applies, and a data subject wishes to arrange for the deletion of personal data stored by LipBoom, he or she may, at any time, contact any employee of LipBoom. The employee will arrange for the deletion request to be complied with immediately.

  1. Legal obligation to disclose personal data to third parties

We would like to point out that we are legally obliged to pass on your personal data to third parties in certain cases (e.g. in the case of criminal prosecution).

Right to information and disclosure

You have the right to receive information about the personal data stored by us at any time. Please send us an e-mail to info@lipboom.ch.

Right of rectification

LipBoom may only process personal data that is correct. If you discover - for example by exercising your right to information - that a piece of information about you is incorrect or has become incorrect, we are obliged to correct it immediately.

Right of deletion

If you wish to have your stored data deleted, please send us an e-mail to info@lipboom.ch. Please also give us your complete name.

Right of objection

If you have a legal right of objection with regard to the data processing described in this data protection information, we will point this out to you at the appropriate place. You also have the option of conveniently exercising your right of objection at the relevant points.

In principle, you have the right to object to (further) data processing in the case of processing based on the legal basis of "legitimate interest" and in the case of processing based on consent.
